  1. Submitting yourself to our trading terms and conditions
    • These are the terms and conditions of SA Laser Engraving and Cerakote Pty Ltd, a private company with limited liability with registration number 2021/394542/07 and its principal place of business at 15 Bootha Plots, Road 3, Randfontein, Gauteng Province (hereinafter referred to as “SLEC”).
    • This document sets out the terms and conditions (“Terms and Conditions”) of SLEC pertaining to the access and use of the information, products, services and functions provided on salaserengraving.co.za (“website”).
    • You must not make any purchase through this site unless you understand and agree to all our terms and conditions.
    • We are a family-owned and run business in the firearm industry in South Africa situated in Randfontein, Gauteng Province.
    • Through our shop premises and through our online shop on this website – we sell unregulated aftermarket parts and products for firearms which are not restricted or controlled under the Firearms Control Act 60 of 2000 (“SLEC products”).
    • We offer specialised services such as custom precision laser grip engraving (custom designs as well as standard and hybrid grip patterns), Cerakote finishes, machining / milling on handguns, shotguns and / or manually-operated and / or self-loading carbines and rifles and an array of other works relating to firearms (“SLEC packages” and / or “SLEC services”).
    • By transacting with us through this website and / or making use of our services and / or purchasing our products, you consent and agree to any such interaction and / or transaction being subject to these trading terms and conditions.
  1. Legall Binding Agreement
    • When you use this website and when you click to make a purchase with us through this website, naturally, a binding contract is concluded and legal obligations arise between you and SLEC.
    • Your rights to any refunds of any monies paid to SLEC are limited by these Terms and Conditions.
    • Once payment is made for the purchase of any SLEC products and / or services; it is deemed that you have read and understood these Terms and Conditions for such purchase.
    • If you have any queries; please contact us via the contact details clearly available under the “Contact Us” segment of our website before making any purchase for any product or service through this website.
  1. Security
    • In order to ensure the security and reliable operation of the services to all SLEC’s website users, SLEC hereby reserves the right to take whatever action it may deem necessary to preserve the security, integrity and reliability of its network and back-office applications.
    • You may not utilise the website in any manner which may compromise the security of SLEC’s networks or tamper with the website in any manner whatsoever, which shall include without limitation, gaining or attempting to gain unauthorised access to the website, or delivering or attempting to deliver any unauthorised, damaging or malicious code to the website, all of which is expressly prohibited. Any person or entity which does so, or attempts to do so, shall be held criminally liable. Further, should SLEC suffer any damage or loss, civil damages shall be claimed by SLEC against the user.
    • Any user who commits any of the offences detailed in Chapter 13 of the Electronic Communications and Transactions Act25 of 2002 (“ECTA”) (specifically sections 85 to 88 (inclusive)) shall, notwithstanding criminal prosecution, be liable for all resulting liability, loss or damages suffered and/or incurred by SLEC and its affiliates, agents and/or partners.

  1. Changes to Website
    • SLEC reserves the right to amend any information of its website products and / or services on this website and these Terms and Conditions in its sole discretion, without notice.
    • SLEC may at any time, without notice, change these Terms and Conditions and your continued use of the Website (or any part of) following such change shall be deemed to be your acceptance of such change.
    • It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed.
    • If you do not agree to any change to the Terms and Conditions then you must immediately stop using the Website.
  1. SLEC’s Prices and Changes to Pricing
    • Product, package and service prices are always subject to change without notice and can be found under the “SLEC Price List” section of the website.
    • All prices will always be reflected in South African Rands (ZAR).
    • All prices are subject to exchange rate fluctuation where relevant and applicable.
    • The price for the product, package and / or service you wish to order is fixed at the time of purchase.
    • It is possible that the price may increase or decrease between the time you added a product, package and service to your shopping cart and the time that you effectively make payment.
    • We always verify prices as part of our online shopping process.
   
  1. Strict observation of the Firearms Control Act 60 of 2000 and its Regulations (as both amended from time to time)
    • As stated, the subjects of SLEC’s services are, more often than not, firearms as defined and regulated by the provisions of the Firearms Control Act 60 of 2000 and its 2004 Regulations (as amended from time to time).
    • SLEC observes and upholds its obligations in terms of the firearm legislation of South Africa with extreme respect and zero compromise.
    • By making use of this website and subjecting yourself to these terms and conditions as a consumer, you guarantee, warrant and undertake to observe the laws of the Republic of South Africa in every respect pertaining to this transaction and your firearm ownership and holding of a firearm licence.
    • By placing an order, you warrant that the products ordered will be used only in a lawful manner and for a lawful purpose as envisaged in Act 60 of 2000.
 
  1. Inherent Risks of firearm modifications and SLEC services
    • SLEC offers the highest standards and quality of work to its customers with every project that it undertakes.
    • It must, however, be noted that SLEC services often entail removing material from firearm receivers, frames, grips and slides in accordance with tried and tested methods and styles, however, the consumer / customer voluntarily assumes the inherent risks associated with any such changes in respect of any firearm that may be subjected to the SLEC services.
    • Further, whilst cerakoting finishes and other finishes are applied in line with industry norms and standards, customers / consumers agree that cerakoting imperfections (especially cerakoting thickness etc) may cause mechanical complexities in respect of firearms and their mechanical operation.
    • Whilst all machining, detailing, engraving and finishing services are performed in line with recognised international standards by SLEC; it must be noted that the performance and application of any modifications and SLEC services to frames, slides, receivers and mechanical systems are performed at the sole and exclusive risk of the customer and SLEC will not accept liability, accountability and / or responsibility for any mechanical failure, malfunction and / or catastrophic malfunction resulting in partial or total damages, loss, injury and / or death.
    • SLEC cannot and does not warrant or guarantee that firearms subjected to SLEC services will offer the same service life, service standards and safety standards as factory firearms.
    • It is the responsibility of the clients and customers of SLEC to ascertain and / or determine whether the relevant SLEC services performed in respect of any particular firearm voids any factory warranty or guarantee in respect of that firearm and SLEC will never assume any liability, responsibility or accountability for any losses and / or damages flowing from such voided warranties or any claims in relation to such voided factory warranties.
    • It is your responsibility to ascertain and obey all applicable domestic (South African) and international statutes, regulations and bi-laws in regard to the possession, use and sale of any item purchased from this website.
  1. Products, Content and Specifications
    • All features, content, specifications, products and prices of products and services described or depicted on this website are subject to change at any time without notice to website users.
    • Certain weights, measurements and similar descriptions are approximate and are provided for convenience purposes only.  We make all reasonable efforts to accurately display the attributes of our products, including the applicable colours; however, the actual colour you see will depend on your computer system and/ or smart device. We cannot guarantee that your computer or smart devices will accurately display such colours.
    • Pictures featured on the website are for illustrative purposes only and may differ from actual product. Please enquire about this if you are unsure.
    • The inclusion of any products or services in this website at a particular time does not imply or warrant that these products or services will be available at any given time and / or in perpetuity.
  10.  Product and Service availability
  • SLEC strives to support the local distributors of the merchandise. Due to the nature of the industry, however, various supply channels have to be kept open to ensure availability of critical items. Some products may therefore be imported through alternative channels. SLEC endeavours to keep adequate stock of all products offered. The nature of the industry may however sometimes lead to unforeseeable stock shortages that cannot be avoided.
  • Further, certain services and modifications may be found to be unsuitable for further use and implementation, in which event SLEC reserves the right to inform you (the consumer) of such unsuitability and to offer alternatives to you.
  • SLEC reserves the right to offer alternative products and / or modifications (services) to you should there be reasonable alternatives available and, upon refusal of such alternatives by you or in the case of no alternatives being available, cancel your order (see refund policy).
11.  Transportation of Firearms and Firearm Components to and from SLEC
  • It must be noted that the subject of SLEC services will more often than not be firearms and / or main firearm components which are subject to the storage, transportation, safekeeping and safe use and handling provisions of the Firearms Control Act 60 of 2000 and its 2004 Regulations (as both amended from time to time).
  • SLEC will only accept orders and perform work on firearms which firearms are brought lawfully before SLEC for any period that SLEC is to perform the SLEC package and / or SLEC services.
  • You, the consumer, will always be liable for the lawful and licensed possession, delivery, safekeeping, transport and collection / return of your licensed firearm(s) to and from SLEC.
  • SLEC will only perform the SLEC services in respect of your licensed firearm and / or main firearm component under your direct supervision or under the direct supervision of a lawful, proper and compliant proxy / agent in terms of the Firearms Control Act and its Regulations as amended from time to time who is lawfully entitled to take possession of, transport and safekeep such firearm or lawful firearm component (“lawful caretaker”).
  • Further, SLEC is not a licensed firearm dealership nor is it a licensed firearm transportation service and does not offer any of the services associated with such businesses to its clients; accordingly, cannot be liable for the loss, damage and / or theft of firearms which must always be in the safe care of the license holder or lawful caretaker.
  • Firearms or main firearm components which are the subjects of a SLEC package and / or services will only be transported (by lawful, registered and licensed firearm transporters only) to lawful destinations of lawful caretakers.
  • Should a customer order custom work in the form of a SLEC package or SLEC services for his / her firearm or main firearm component, the customer will be responsible for arranging such lawful firearms courier at the customer’s own cost and risk to and from a lawful caretaker to bring such firearm lawfully before SLEC.
  • The transportation of firearms or main firearm components to lawful third parties is a relationship entered into between the customer and such third party and SLEC cannot and will not be responsible for the safekeeping or any other obligation in relation to such firearm and / or main firearm component under the care and control of a lawfully authorised and responsible third party. From the date of a firearm being signed into the register of a lawfully licensed and / or authorised third party (other than the customer, but for and on behalf of the customer where lawful) to the date of it being signed out of such third party’s register – such firearm and / or main firearm component are the responsibility of the customer and / or the lawful and authorised third party responsible therefor.
  • A person with the requisite competency to trade from such lawful and authorised third party, lawfully reflecting in such entity’s register (“lawful caretaker”) will take responsibility for a firearm or main firearm component from safekeeping facilities at the lawful caretakers lawful premises, to SLEC for the implementation and / or performance of the SLEC package and / or the SLEC services on such firearm or main firearm component and return such firearm to the lawful safekeeping facilities of the lawful caretaker for lawful safekeeping in line with the Act and its Regulations upon completion of the performance of the package and / or services at SLEC under the direct supervision and care of the lawful caretaker.
  • SLEC fully reserves it rights to refuse to perform the SLEC services / implement the relevant SLEC packages if SLEC is not satisfied as to the lawfulness of the customer or the customer’s lawful caretaker’s possession of the firearm or main firearm component.
  1. Insurance
    • SLEC will insure SLEC products purchased through its online store prior to shipping against risk should the customer specifically request such insurance and should the carrier offer such insurance.
    • The insurance of your firearm, main firearm component and / or any accessories attached thereto or sent therewith to a lawfully, authorised lawful caretaker per clause 11 above for SLEC services are your sole and exclusive responsibility at any time.
    • SLEC will always exert every reasonable effort in safeguarding and looking after your assets, however, will not accept liability for losses or damage which cannot be reasonably foreseen or prevented whilst such items are under SLEC’s control.
    • Further, SLEC is not a licensed firearm dealership nor is it a licensed firearm transportation service and does not offer any of the services associated with such businesses to its clients; accordingly, cannot be liable for the loss, damage and / or theft of firearms which must always be in the safe care of the license holder or a party lawfully entitled to be in possession of such firearm on behalf of the license holder.
  1. Performance Turn-Around Time
    • Every effort is made to complete the services within the agreed time periods in respect of customer orders, however, unforeseen circumstances may cause delays and both foreseeable and unforeseeable delays will be reasonably communicated by SLEC to its clients.
    • Should SLEC be faced with such an occurrence SLEC will endeavour to contact you and provide a reasonable revised performance and delivery schedule / timeline.
14.  Undeliverable packages
  • Occasionally packages embodying SLEC products purchased off of the SLEC website are returned to SLEC as undeliverable. Should this event take place every attempt will be made to contact you to make arrangements for re-shipment – so it is your responsibility to ensure that you are contactable and that you have given the correct contact details.
  • This clause does not apply firearms or main firearm components which are the subjects of SLEC packages and / or SLEC services (custom work on firearms or main firearm components) – as per clause 11, the transportation and courier of such firearms are at the cost, risk and responsibility of customers.
15.  Order Processing Order processing will not begin until we receive a confirmed order and full payment reflects in our bank account. 16.  Breach and Cancellation Policy
  • SLEC is entitled without notice, in addition to any other remedy available to it at law or under these Terms and Conditions, including obtaining an interdict, to cancel these Terms and Conditions, limit or deny a website user use of the website and services, or to claim specific performance of any obligation whether or not the due date for performance has arrived, in either event without prejudice to SLEC’s right to claim damages, should any user:
    • breach any of these Terms and Conditions;
    • in the sole discretion of SELC, use the Website in an unauthorised manner; or
    • infringe any statute, regulation, ordinance or law.
  • Breach of these Terms and Conditions entitles SLEC to take legal action without prior notice to the customer and / or user and the customer and / or user agrees to reimburse the costs associated with such legal action to SLEC on the scale between attorney and own client.
17.  Warranty and Refunds Policy Warranty
  • SLEC warrants that all SLEC products, SLEC packages and SLEC services are of a high quality and / or high standard of workmanship (where applicable) in line with international standards within SLEC’s industry and that such SLEC products, SLEC packages and SLEC services are free of defects upon completion.
Defective Products and / or Services
  • Should there however be a product which does not meet our quality warranty within a reasonable period, prior to returning such alleged faulty product to SLEC for remedy; you agree to contact us first and fully cooperate in determining the nature, degree and extent of the alleged defect so that we can provide you with the necessary details to effect the return and remedy.
  • In the unlikely event that any SLEC product or other product having been the subject of SLEC’s services should become faulty during the warranty period pertaining to that particular product, package and / or service, the product may be returned in order to effect repair / remedy or, where necessary and suitable in the eyes of our experts at SLEC; replacement.
  • Upon return of a product, package or service SLEC will, within a reasonable period and at their sole and exclusive discretion; determine if the repair or replacement should be honoured under the terms of the warranty.
  • SLEC’s decision will be communicated to the consumer within a reasonable period and such decision will be final and no further correspondence will be entered into in this regard.
  • Should a product or service be found to be faulty within 7 days from having received your order, SLEC will cover the reasonable costs for both the collection and return of the product. If later than that; then the costs for the collection and return of the product will be for the consumer’s account.
  • It is crucial to note that any subsequent work and / or tampering by the customer and / or a third party under the direction of the customer or otherwise in respect of any product or firearm which was the subject of SLEC work and / or services, will void any SLEC warranty.
Section 44 of Electronic Communications and Transactions Act Number 25 of 2002
  • After placing your order, a customer is entitled to cancel without reason and without penalty any transaction for the supply of SLEC products and / or SLEC services within seven days after the date of the receipt of the SLEC products, or, in the case of SLEC services, within seven days after the date of the conclusion of the agreement (date of the online order being placed).
  • The cost of returning any SLEC product purchased through the SLEC website (SLEC product not SLE service) will be for the customer’s account should the customer elect to exercise such cooling off right in terms of s44(1) of ECTA.
  • If payment for the goods or services has been effected prior to a consumer exercising a right referred to above, the consumer is entitled to a full refund of such payment, which refund will be made within 30 days of the date of cancellation.
  • It is, however, very important to note that SLEC primarily offers SLEC services in the form of the customisation and personalisation of consumer products / assets / items (mostly firearms) and, in terms of section 42(1)(f), where goods are made to the consumer’s specifications, are clearly personalised and by reason of their very custom and unique nature, the actual SLEC services cannot be returned to SLEC for any value to SLEC and the section 44 “cooling-off” right does not apply to the majority of SLEC’s products, packages and services.
       
  1. Limitation of Liability in terms of Products and Services
    • In those cases, where SLEC is liable to the customer for any reason whatsoever, in no such case whatsoever shall any liability of SLEC, howsoever arising, exceed whichever is the greater of the following respective amounts:
      • the value of the product purchased; and
      • double the amount of the charges raised by SLEC for its services.
 
  1. Indemnities
    • The customer indemnifies SLEC against any claims, proceedings compensation or costs payable which are the unavoidable result of the SLEC products and / or SLEC services or of providing the SLEC products and / or SLEC services which arise from:
      • fault
      • negligence
      • breach of statutory duty
      • infringement of an intellectual property right or
      • interference with a legal right
by the customer or by any third party.  
  1. Vis Major (Acts of God)
    • Neither SLEC nor the customer shall be liable for its inability to carry out any of the obligations embodied in these terms and conditions resulting or caused by reason of act of God, strikes, lockouts of workmen, riots, wars (declared or undeclared), statutes, government imposed lockdowns and states of emergency, any executive acts of the government, terrorism, civil disturbance, unforeseeable plant shutdown, equipment failure, voluntary or involuntary compliance with any applicable governmental regulation or order, or shortage or inability to obtain (on terms deemed reasonable by the Party affected) any raw material (including energy), equipment or transportation, which materially impairs such Party’s ability to so perform, or any catastrophe, such as fire, earthquakes, or floods or famine, or accident, or pandemic, or epidemic, or any similar cause beyond the control of either Party .
    • SLEC shall not be obligated to rebuild or repair any damage or destruction to any hardware or any portion of its premises which damage flows from the circumstances mentioned above. SLEC shall also not be obligated to obtain any raw materials from other sources than its usual sources.
    • During any period when SLEC is unable to supply the quantity of the products / hardware and services under this agreement, SLEC’s obligations in respect of performance of the services and delivery of any products will be automatically suspended if caused by the circumstances above (or any other unforeseeable circumstances outside of the control of SLEC and / or the customer) and any obligations, if possible (depending on the circumstances), shall be performed on the basis of time is of the essence upon the ceasing to exist / upliftment / relaxation of the act of God or impeding event (force majeure).
    • Upon the ceasing to exist / upliftment / relaxation of the act of God or impeding event (force majeure), the Parties will engage on the possibility of the continuity of this Agreement and will in good faith determine a re-commencement date in respect of both Parties’ respective obligations, which date shall not exceed 20 business days from the ceasing to exist / upliftment / relaxation of the act of God or impeding event (force majeure.)
    • Should the act of God or impeding event (force majeure) render continuity of this Agreement impossible, the Parties will in good faith negotiate termination terms which mitigate the extent of damage and loss to both Parties to the greatest extent possible and both Parties will be relieved, without any liability or claim against the other Party, of their respective obligations in respect of this Agreement. Any quantities not delivered or accepted because of any such event shall be eliminated from this Agreement without liability.
    • Delays or non-performance stemming from any act of God, catastrophic event, natural disaster or impeding event (force majeure) shall not be interpreted to constitute breach of the terms of this Agreement.
 
  1. Website use and voluntary assumption of risk by website user
    • SLEC shall not assume any responsibility and / or accept any accountability and / or be liable for any damages to, or viruses that may infect, your computer, telecommunication equipment, or other property caused by or arising from your access to, use of, or browsing this website or your downloading of any materials, from this website.
    • In no event will SLEC or its directors, employees, shareholders, affiliates, agents, successors, assigns, retail partners nor any party involved in the creation, updating, maintenance, production and / or transmission of this website be liable to any party for any form of losses and / or damages whatsoever (including, without limitation, those resulting from lost profits, lost data or business interruption) arising out of the use, inability to use, or the results of use of this web site, any web sites linked to this web site, or the materials, information or services contained at any or all such sites for any reason whatsoever.
    • In the event of any problem with this website or any content, you agree that your sole remedy is to cease using this website and report such fault to SLEC.
    • In the event of any problem with the products or services that you have purchased on or through this website, you agree that your remedy, if any, is to seek the remedy of such defect in accordance with the returns and refunds policies posted on this website.
    • This website may include inaccuracies, mistakes or typographical errors. SLEC does not warrant that the content will be accurate, correct, uninterrupted or free of any errors.
    • The owner of this site, the authors of these contents and in general anybody connected to this site in any way, from now on collectively called “Providers”, assume no responsibility for errors or omissions in these contents. The Providers further do not warrant, guarantee or make any representation regarding the safety, reliability, accuracy, correctness or completeness of these contents.   • The website user bears all risk of transmitting information in this manner. Under no circumstances shall SLEC be liable for any loss, harm, or damage suffered by the user as a result thereof.
  • SLEC reserves the right to request independent verification of any information transmitted via e-mail and the user consents to such verification should service provider deem it necessary.
  • To the extent permissible by law, neither SLEC, its affiliates, shareholders, agents, consultants or employees shall be liable for any damages whatsoever, including without limitation any direct, indirect, special, incidental, consequential or punitive damages, howsoever arising (whether in an action arising out of contract, statute, delict or otherwise) related to the use of, or the inability to access or use the content of the website or any functionality thereof, or the information contained on the website, or of any linked website, even if service provider knows or should reasonably have known or is expressly advised thereof.
  • You hereby unconditionally and irrevocably indemnify SLEC and agree to hold SLEC free from all loss, damages, claims and/or costs, of whatsoever nature suffered or incurred by SLEC or instituted against SLEC as a direct or indirect result of:

  • SLEC makes no warranty or representation as to the availability, accuracy or completeness of the content of the website. You expressly waive and renounce all your rights of whatever nature that you may have against SLEC for any LOSS suffered by you, as a result of information supplied by SLEC being incorrect, incomplete or inaccurate.
 
  1. Confidentiality
 
  • By subscribing as a user, you agree that you shall hold in the strictest confidence and not disclose to any third party information acquired in connection with any aspect of the SLEC products and/or SLEC services offered by SLEC. You shall notify SLEC should you discover any loss or unauthorised disclosure of the information.
  • Any information or material sent to SLEC will be deemed not to be confidential, unless otherwise agreed in writing by the user and SLEC.
 
  1. Intellectual Property
 
  • “Intellectual property rights” means all and any of the rights in and to intellectual property of any nature whatsoever owned and/or controlled directly or under licence by SLEC, now or in the future, including without limitation, SLEC’s rights, title and interest in and to all technology, source code/s, trade secrets, logos, systems, concepts, methods, trademarks, trade names, styles, insignia, designs, patents and copyright, and all similar proprietary rights which may subsist in any part of the world, whether registered or not.
  • All copyright and other intellectual property rights in all content, trademarks, software, data, material, including logos, databases, text, graphics, icons, hyperlinks, confidential information, designs, agreements, and multimedia works, published on or via the website (“proprietary material”), are the property of, or are licensed to, SLEC and as such are protected from infringement by local and international legislation and treaties.
